Acceptable Use Policy
 

1 Access to HKSpace Network's Data Centre(s)

1.1 Registration and Representation
1.1.1 Those individuals who have been identified and authorized in writing by the Subscriber on the Data Centre Access Registration Update Form and the Pre-installation Form (Server Co-location and Dedicated Hosting) may have access to the Data Centre(s). The said Data Centre Access Registration Update Form and the Pre-installation Form (Server Co-location and Dedicated Hosting) should be filled in and signed by the authorized person with company chop and submitted, either by post or by fax, to HKSpace Network.
1.2 Admission to HKSpace Network's Data Centre(s)
1.2.1 HKSpace Network reserves the right to prohibit any one who is not the Subscriber Authorized Representative to enter the Data Centre(s).
1.2.2 The Subscriber Authorized Representatives should observe the verification process of HKSpace Network prior to entering the Data Centre(s).
1.2.3 The activity of the Subscriber Authorized Representatives are only confined to access or enter restricted area of the HKSpace Network's Data Centre(s), unless otherwise approved and accompanied by an authorized HKSpace Network's personnel.

 

2 Use of HKSpace Network's Data Centre(s) Facility

2.1 Conduct at Data Centre
2.1.1 Subscriber and its Authorized Representatives agree to adhere to and abide by all measures established by HKSpace Network contained in the Data Centre Service Guide provided by HKSpace Network to Subscriber. Further, Subscriber and its Authorized Representatives shall not do or participate in any of the following:
2.1.1.1 Misuse or abuse of any Company Equipment or third party equipment;
2.1.1.2 Make any unauthorized use of or interfere with any property or equipment of any other HKSpace Network Subscriber;
2.1.1.3 Harass any individual, including HKSpace Network personnel or representatives of other HKSpace Network Subscribers; or
2.1.1.4 Engage in any activity that is in violation of the Applicable Law or aids or assists any activity that is in violation of the Applicable Law.

2.2 Prohibited Items
2.2.1 Subscriber and its Authorized Representatives shall keep its area clean at all times. It is each Subscriber's responsibility to keep its area clean and free and clear of debris and refuse. Subscriber shall not, except as otherwise agreed to in writing with HKSpace Network:
2.2.1.1 Place any Equipment in the area that has not been identified in writing to HKSpace Network;
2.2.1.2 Store any paper products or other combustible materials of any kind in the area (other than equipment manuals); and
2.2.1.3 Bring any Prohibited Materials (as defined below) into any Data Centre.
2.2.2 "Prohibited Materials" shall mean the following and similar items:

Food and drink;
Tobacco products;
Explosives and weapons;
Hazardous materials;
Alcohol, illegal drugs and other intoxicants;
Electro-magnetic devices which could unreasonably interfere with computer and telecommunications equipment;
Radioactive materials; and
Photographic or recording equipment of any kind (other than tape back-up equipment).

2.2.3 HKSpace Network may from time to time on notice to the Subscriber vary the list of those materials that are considered Prohibited Materials within the meaning of this Acceptable Use Policy.

2.3 Equipment and Connections
2.3.1 All Subscribers’ Equipment must be clearly labeled with Subscriber's name and individual component identification. Each connection to and from a piece of Subscriber's Equipment shall be clearly labeled with Subscriber's name and the starting and ending point of the connection. Subscriber's Equipment must be configured and run at all times in compliance with the manufacturer's specifications, including power outlet, power consumption and clearance requirements. Subscriber must provide HKSpace Network with prior notice of any time it intends to connect or disconnect any Subscriber's Equipment or other equipment.

2.4 Cabling
2.4.1 The Subscriber shall not extend any cable or other equipment of whatever nature outside of its area without HKSpace Network' prior written consent. If HKSpace Network approves a request from the Subscriber to extend cabling outside of its area;
2.4.2 In the case of an approval for cabling between two or more areas which HKSpace Network regards (in its absolute discretion) as being immediately adjacent, then such cabling shall be undertaken by the Subscriber or its subcontractors; and
2.4.3 In the case of all other approvals by HKSpace Network, then such cabling shall be undertaken by HKSpace Network or its subcontractors at the Subscriber's cost (as agreed between the parties prior to installation of the cabling).

2.5 Subscriber Content

2.5.1 Subscriber acknowledges that HKSpace Network exercises no control whatsoever over the content of the information passing through Subscriber's Website(s) and that it is the sole responsibility of Subscriber to ensure that the information it and its users transmit and receive complies with all Applicable Laws and regulations.

2.5.2 Subscriber should upload Subscriber Content from the source server to the collocated server via a dedicated link. HKSpace Network may terminate the Service without any refund of charges, if HKSpace Network discovers any inbound traffic being routed through routes which may increase the loading of HKSpace Network's local and international bandwidth.

2.6 Overall System Security
2.6.1 The Subscriber must not place generic or guest accounts on its systems.
2.6.2 No direct modem or dial-back modem access is permitted into systems.

2.7 Prohibited Activities
2.7.1 Subscriber will not be permitted and should not permit any persons ("Users") using Subscriber's online facilities and / or services, including Subscriber's Web Site(s) and transmission capabilities, to do, but are not limited to, any of the followings ("Prohibited Activities"):
2.7.1.1 Sending unsolicited mail messages, including the sending of junk mail or other advertising material to individuals who did not specifically request such material, who are not Subscribers of the Subscriber or with whom the Subscriber does not have an existing business or otherwise relationship ("E-mail Spam");
2.7.1.2 Illegal or unauthorized access, probe or scan of other systems or networks (often known as "hacking" or "cracking");
2.7.1.3 Disrupt or attempt to discrupt other systems or networks from normal operations (often known as "Denial of Services");
2.7.1.4 Store or distribute certain prohibited materials including, but are not limited to, programs containing viruses or Trojan horses and tools to compromise the security of other sites;
2.7.1.5 Intentionally omit, delete, forge or misrepresent any transmission information, including headers, return mailing and Internet protocol addresses;
2.7.1.6 Harassment, whether through the language, frequency or size of messages;
2.7.1.7 Unauthorized use, or forging, of mail header information;
2.7.1.8 Solicitations of mail for any E-mail address other than that of the Subscriber's account or service with the intent to harass or to collect replies;
2.7.1.9 Creating or forwarding chain letters or other pyramid schemes of any type;
2.7.1.10 Resells HKSpace Network services and products, without the prior consent of HKSpace Network
2.7.1.11 Engage in deceptive on-line marketing practices;
2.7.1.12 Engage in any activities or actions that infringe or misappropriate the intellectual property rights of others, including, but not limited to, using third party copyrighted materials without appropriate permission, using third party trademarks without appropriate permission or attribution, and using or distributing third party information protected as a trade secret information in violation of a duty of confidentiality;
2.7.1.13 Engage in any activities or actions that would violate the personal privacy rights of others, including, but not limited to, collecting and distributing information about Internet users without their permission, except as permitted by any Applicable Law;
2.7.1.14 Send, post or host harassing, abusive, libelous or obscene materials or assist in any similar activities related thereto; intentionally omit, delete, forge or misrepresent transmission information, including headers, return mailing and Internet protocol addresses;
2.7.1.15 Engage in any activities or actions intended to withhold or cloak Subscriber's or its Users; identity or contact information;
2.7.1.16 Use the HKSpace Network's connectivity services for any illegal purposes, in violation of any applicable laws or regulations or in violation of the rules of any other service providers, web sites, chat rooms or the like assist or permit any persons in engaging in any of these activities; and
2.7.2 If Subscriber becomes aware of any Prohibited Activities, Subscriber will immediately take all necessary actions at its disposal to prevent such Prohibited Activities continuing, including, where appropriate, limiting or terminating User's use of the relevant Subscriber's Services.

 

3 Suspension of Service

HKSpace Network reserves the right to immediately suspend a Subscriber's Service at any time if it reasonably suspects that there is or will be a breach of this Acceptable Use Policy by the Subscriber, its Representatives or its Users.

 

4 Maintenance Service

HKSpace Network will conduct routine scheduled maintenance of its data centers according to its maintenance schedule. In the event a mission critical maintenance situation arises, HKSpace Network may be required to perform emergency maintenance at any time. During these scheduled and emergency maintenance periods, Subscriber's Equipment may be unable to transmit and receive data and Subscriber may be unable to access the Subscriber Equipment. Subscriber agrees to cooperate with HKSpace Network during the scheduled and emergency maintenance periods.

 

5 Modifications of Rules and Regulations

HKSpace Network may at any time and at its absolute discretion amend or vary the terms of this Acceptable Use Policy by giving the Subscriber not less than thirty [30] days' prior written notice of such amendments or variations. By continuing to use the Services without making any objection to such amendments or variations within thirty [30] days of such notice, the Subscriber is deemed to accept the same. For the purposes of this Clause, publication or posting of such amendments or variations on HKSpace Network's Website or by e-mail to the Subscriber shall constitute written notice.
